22.06.2022.
54.
Ct.No.28.
as (Rejected) C.R.M. (DB) 1962 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Kolkata Leather Complex P. S. Case No.97 of 2017 dated 18.04.2017 under Sections 364/302/120B/34 of the Indian Penal Code. In the matter of : Sofiq Dhali @ Safiqul Dhali. .... Petitioner.
Mr. Neil Basu, Mr. Subhrajit Dey.
...for the Petitioner.
Mr. Mmadhusudan Sur, ld. A.P.P., Mr. Dipankar Paramanick.
...for the State.
Heard the learned Counsels appearing on behalf of the parties.
Petitioner renews his prayer for bail. It is submitted he has been falsely implicated in the instant case. Learned Advocate for the State opposes the prayer for bail.
We have considered the materials on record prima facie disclosing involvement of the petitioner in the murder. Trial has sufficiently progressed and six more witnesses have been examined since last rejection of bail by this Court. In view of the aforesaid facts, we are not inclined to grant bail to the petitioner.
Accordingly, the prayer for bail of the petitioner is rejected.
Trial court is requested to expedite the trial and conclude the same at an early date without granting unnecessary adjournment to either of the parties.
