Affidavit filed on behalf of the opposite party, Dipak Kumar Malakar is taken on record.

Ms. Nahid Ahmed, learned Advocate for the opposite party submits that pursuant to the order passed by this Court on 8th May, 2025, disciplinary proceedings has been initiated against the incumbent and final order has been passed. The opposite party tenders unqualified and unconditional apology. She seeks for acceptance of such unconditional apology and discharge of the Rule.

Perused the affidavit filed on behalf of the opposite party. The opposite party tenders unqualified and unconditional apology before this Court. It is also found from Annexure P2 at page 7 of the affidavit that the Superintendent of Police, Ranaghat Police District has passed final order on 5th June, 2025 as follows:

"Upon judicious application of mind to the matter, CO.SI(UB) Dipak Malakar of Hanskhali PS of Ranaghat PD is awarded punishment of stopping one (01) increment for three (03) months without cumulative effect."

Considering the above, the Rule is hereby discharged. The unconditional apology tendered by the opposite party is accepted. However, a caution is issued upon the opposite party to adhere to the rules while discharging his duties as an investigating officer in near future.

Accordingly, CRR 2344 of 2025 stands disposed of. (Bivas Pattanayak, J.)
