23.06.2022 sdas rejected C.R.M. (DB) 1952 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Hanskhali Police Station Case No. 264 of 2018 dated 09.08.2018 under Sections 376/325/326/307 of the Indian Penal Code.
And In Re : Ripan Sikdar @ Ripon Sikder ..... petitioner Ms. Sananda Bhattacharyya ... for the petitioner Mr. S. S. Imam Mr. S. Kundu ... for the State Petitioner renews his prayer for bail.
Learned Counsel appearing for the petitioner submits that there is slow progress in the trial of the case. Learned Counsel appearing for the State opposes the prayer for bail.
We have considered the materials on record. Trial has already commenced.
Keeping in mind the aforesaid fact and gravity of the offence and as prayer for bail was rejected earlier, we are not inclined to grant bail to the petitioner at this stage. The application for bail is, thus, rejected. Trial court is directed to conclude the trial at the earliest without granting any unnecessary adjournment to either of the parties.
