Learned counsel appearing on behalf of the petitioners submits as follows. The petitioners have been falsely implicated in this case due to political grudge. The FIR was lodged on 20.05.2026, showing the date of occurrence as 05.05.2021.
Learned counsel appearing on behalf of the State relies on the case diary and opposes the prayer for anticipatory bail. This is one of the cases of post poll violence that took place after the election of 2021. It is alleged that the victims were attacked, assaulted and driven out of their own houses. They were also made to part with certain sums of money merely because they belonged to the then opposition party in the State. The area was where an infamous mafia don operated. Quite obviously, the de facto complainant was afraid of approaching the police authorities at the relevant time. He refers to the statements of witnesses, implicating the present petitioners.
Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail to the present petitioners. The application for anticipatory bail of the petitioners is, thus, rejected.
Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
