From track reports it is seen due service of notice on the opposite parties. None appears from the side of the opposite parties. Heard the learned advocate for the petitioner. By filling the present revisional application under Article 227 of the Constitution of India, the petitioner has prayed that learned Civil Judge, (senior Division), Bankura, be directed to dispose of the issue regarding Court fees payable for cancellation of deed learned Court below by granting unnecessary adjournment is not taking up the above issue and which is causing delay in disposal of the case.
Since the petitioner has prayed for hearing of the issue on Court fee payable for cancellation of the deed no interest of the opposite parties is likely to be prejudiced. Therefore, the prayer is allowed. The learned Court below is directed to dispose of the issue relating the Court fee at the earliest, in any event within a period of a month from the date of communication of this order.
Accordingly, the revisional application being C.O. 1401 of 2021 is disposed of.
There shall be no order as to costs.
