Shyam Roy v. State Of West Bengal
15.06.2026 Court No.28 Item No.75 tbsr Reject CRM (A) 1566 of 2026 In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Haridevpur P.S. Case No. 179 of 2026 dated 24.05.2026 under Sections 308(5)/3(5) of the BNS, 2023.
And In the matter of: Shyam Roy ....Petitioner.
Mr. Moyukh Mukherjee Ms. Sagnika Banerjee ...for the petitioner.
Mr. Ramasish Mukherjee Ms. Rima Banerjee ....for the State.
Report filed on behalf of the State is taken on record. Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner has been falsely implicated in this case due to the political vendetta. A strange allegation has been levelled in 2026 that extortion had been carried on from 2013 to 2025, although no prior complaint was lodged. The principal accused was arrested and was thereafter granted bail.
Learned counsel appearing on behalf of the State relies on the case diary and opposes the prayer for anticipatory bail. He relies on the statements of witnesses and the criminal antecedents of the petitioner. He also submits that there are as many as 9 criminal antecedents against the present petitioner including cases under the Arms Act and under Sections 326 and 387 of the Penal Code.
Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail.
Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
