The petitioner is an octogenarian man who resides in his own house with his wife. The petitioner alleges that the private respondents who are the wife and children of his deceased son and reside in the same house have been torturing and assaulting him and his wife on demand of property. The petitioner submitted a representation before the police authority in this regard on 15th March, 2025. He seeks police protection.

Denying and disputing the aforesaid allegation, the private respondents submit that they have filed a civil suit against the petitioner seeking decree for declaration and injunction.

It appears from the report submitted by the State that pursuant to the representation submitted by the petitioner Sonarpur P.S case no. 989/25 dated 25th June, 2025 has been initiated and investigation is in progress. The police authority has agreed to provide all sorts of assistance to the petitioner.

Since the investigation is in progress, the investigating officer is directed to conduct a fair and impartial investigation and take the same to its logical conclusion in accordance with law.

In the meantime, the police authority shall keep strict vigil in the area in view of the alleged torture and assault meted out upon the petitioner and his wife and shall render all possible assistance/protection to the petitioner and his wife as and when sought.

The police authority shall visit the house of the petitioner once every day and ensure that peace and tranquility is maintained.

The writ petition is accordingly disposed of. There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
