And In Re : Obaidul Sk @ Obaidur Sekh ...... petitioner Md. Wasim Akram ....for the petitioner Mr. Saibal Bapuli Mr. Soumik Ganguly ....for the State The materials in the case diary suggest that, the petitioner is involved in a racket of stealing mobile phones from unsuspecting members of the public.

Filing of charge-sheet is a ground canvassed for seeking anticipatory bail. Mere filing of the charge-sheet is of no consequence. We are to consider the involvement of the petitioner in the incident and the gravity of the offence. Father of the petitioner was arrested. Stolen mobile phones were recovered. Nexus of the petitioner with the stealing of mobiles cannot be overlooked.

In such circumstances, we are unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 2055 of 2023 is dismissed.
