According to the learned advocate, there has been alleged recovery of 2 kg 906 gm ganja which was intercepted at the Airport. Learned advocate for the Customs Authority opposes the prayer for bail.
I have taken into account the proposition laid down in Barnali Bag -v- Union of India [Special Leave Petition (Crl.) No. 3641 of 2026], wherein emphasis was on intermediate quantity.
Having considered the same and the fact that the complaint has been filed before the learned jurisdictional court, I am inclined to enlarge the petitioner on bail.
Hence, the prayer for bail of the petitioner is Allowed.
Accordingly, the petitioner viz, Yashwant Singh shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, both of whom must be local, to the satisfaction of the Learned CJM, Barasat, North 24 Parganas.
If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special court/trial court and shall not leave the district of North 24 Parganas without prior permission of the learned Special Court/trial court.
Additionally, the petitioner shall meet with the Investigating Officer of the case or any competent officer assigned by the Principal Commissioner, Air Cargo Complex once in a fortnight till further orders of this court. In case, if there is any violation of the aforesaid condition, the learned Special Court would be at liberty to cancel the bail without further reference of this court. Accordingly, CRM (NDPS) 1179 of 2026 is allowed. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
