Learned senior counsel appearing on behalf of the petitioner submits as follows. Exactly similar allegations were levelled against the same present petitioner in an earlier FIR. It was alleged that the petitioner, an advocate and a Councilor of the Municipality, had engaged people to collect illegal levies from hawkers. The petitioner had, in fact, been the President of the Bidhannagar Bar Association and Mayor in Council of the Bidhannagar Municipality. She has been falsely implicated in this case due to political reasons. In view of the fact that earlier an FIR was registered with exactly similar allegations, the present FIR cannot even be sustained in the eye of law. By an order dated 15.06.2026 passed by this Court in CRM(A) 1495 of 2026, the petitioner was granted anticipatory bail in the said earlier case.
Learned counsel for the State relies on the case diary and opposes the prayer for anticipator bail. He refers to some local hawkers.
Considering the above, the other materials available in the case diary, the fact that the petitioner was granted anticipatory bail in respect of an earlier FIR containing substantially similar allegations and the fact that the petitioner is a lady, I do not think that custodial interrogation of the petitioner is required in this case and I am inclined to grant anticipatory bail to the petitioner. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further condition that the petitioner shall cooperate with investigation and shall not threaten or intimidate witnesses and shall not travel abroad without the leave of this Court.
The application for anticipatory bail is, thus, allowed. Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for.
