For the Petitioners The grievance of the petitioners is that they filed an application under Section 125 of the Code of Criminal Procedure, 1973 for their maintenance in the month of October 2020. The said application is pending before the learned 3rd Judicial Magistrate, Alipore, 24 Parganas (South).

Till date, the application has not been disposed of though the opposite party no. 2 appeared in the proceedings. An application for maintenance should be heard within a reasonable time period.

This revisional application is disposed of with a direction upon the learned Magistrate in the Court below, to consider the prayer of interim maintenance to the petitioners, and dispose of the same within a period of five months from date.

CRR 1605 of 2021 is disposed of.
