In terms of the earlier order dated 5th June, 2023 passed by this Court, the Behala Police is represented.

The instructions of the Behala Police Station dated 6th June, 2023 in the form of instructions addressed to the State Advocate are filed. The same is kept on record.

It appears therefrom that rigorous attempts are being made to trace out the accused persons but in vain.

The petitioner appears to have been defrauded into paying a sum of Rs.3,24,000/- for obtaining a loan of Rs.5,00,000/-. The police have tried to trace out phone numbers of the accused persons but in vain.

The Bank in question has been contacted and documents have been seized. There is a warrant of arrest against Gulfam Saifi and Prem Kumar.

Since Behala Police Station have made their efforts in the FIR and no fruitful results have come out, this Court directs that the investigation into FIR No.317 of 2020 dated 18th October, 2020 be transferred to Criminal Investigation Department, West Bengal. The CID, West Bengal shall make all efforts and complete the investigation within a period of two months from date.

With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
