In view of the admitted position that the relationship of the parties is not governed by the provisions of West Bengal Premises Tenancy Act, 1997 and the tenancy has been duly determined by serving a notice under Section 106 of the Transfer of Property Act, we do not find any reason to interfere with the concurrent findings of fact arrived at by both the Courts that the tenancy has been validly determined. However, there is no substantial question of law involved in this matter.

Accordingly, the second appeal being SAT 182 of 2019 stands dismissed.

However, there shall be no order as to costs. Urgent Photostat certified copy of this order, if applied for, be given to the parties on usual undertaking. (Sugato Majumdar, J.) (Soumen Sen, J.)
