The grievance of the writ petitioner is that his result of Madhyamik Examination, 2021 was not published though he was a student of Domkal B.T. High School, District- Murshidabad. It has been contended on behalf of the writ petitioner that he complied with all formalities relating to his enrolment for Madhyamik Examination, 2021 with the West Bengal Board of Secondary Education through the said school authority but the respondent authorities failed to publish result. Petitioner prays for publication of his result of Madhyamik Examination, 2021 upon compliance of formalities of enrolment with the Board.
Ms. Koyeli Bhattacharya appears on behalf of the West Bengal Board of Secondary Education and submits that the result of Madhyamik Examination, 2021 was published on 20th July,
2021 and from the writ petition it appears that the father of the writ petitioner made application to the West Bengal Board of Secondary Education on 27th July, 2021 based on registration number which was allotted to the petitioner when he was in ClassIX. The attention of this Court has also been drawn to another letter dated 27th July, 2021 written by the father of the writ petitioner addressed to the headmaster of Domkal B.T. High School, DistrictMurshidabad for supply of marksheet and certificate of the petitioner in respect of Madhyamik Examination, 2021. It is submitted by Ms.
Bhattacharya that since result was published on 20th July, 2021 and within time petitioner was not enrolled with the Board through the said school authority the performance of the writ petitioner could not be assessed as a result whereof result of the said examination could not be published.
The State respondents are represented by Mr. Mitra, learned advocate who has also reiterated the submission made on behalf of the West Bengal Board of Secondary Education.
Having considered the submissions made on behalf of the respective parties to this writ petition this Court finds that the result of Madhyamik Examination, 2021 was published on
20th July, 2021 and for the first time approach was made by the father of the writ petitioner on 27th July, 2021 to the Board and the school authority for publication of result. Since the writ petitioner could not enroll himself with the Board through the school authorities of Domkal B.T. High School, Distrcit- Murshidabad no order can be passed in favour of the writ petitioner for publication of the result and supply of marksheet.
In above conspectus, the writ petition stands dismissed.
