1. Learned advocate appearing for the petitioner earlier had drawn the attention of the Court that although the prosecution before this Court had submitted that two witnesses were left to be examined, but subsequently, the learned Public Prosecutor recalled number of witnesses. As such, the trial of the case would consume more time. The petitioner is in custody since 17th October, 2023, for about 2 years 8 months.
2. Dr. Pradip Banerjee, learned Additional Public Prosecutor, along with Mr. Amal Kumar Datta, learned Advocate was directed to represent the State in the present case. Their appearance may be regularized.
3. Learned advocate appearing for the State opposes the prayer for bail but submits that presently, the evidence of the Investigating Officer would be deferred and the witnesses who have been recalled would be examined.
4. On a specific query from this Court, learned advocate for the State submits that he case diary does not reflect that there are any criminal antecedents of the present petitioner.
5. Having considered the period of detention of the present petitioner, I am inclined to release the petitioner on bail.
6. As such, the prayer for bail of the petitioner, namely, Nisar Ali @ Rasel @ Nishar Ali @ Rasek Sk @ Nesar Ali is allowed.
7. Accordingly, the petitioner shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned ACJM, Lalbagh, Murshidabad.
8. If on bail, the petitioner shall be physically present before the learned Trial Court on each and every date. Petitioner shall not leave the district of Murshidabad without prior permission of the learned Trial Court.
9. In the event, the petitioner fails to comply with any of the conditions as stated above, the learned Trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.
10. Accordingly, CRM (M) 1379 of 2026 is disposed of.
11. Investigating Officer is present pursuant to the direction passed by this Court. His further appearance before this Court is dispensed with.
12. All parties shall act in terms of the server copy of the order downloaded from the official website of this Court.
13. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
