1. Affidavit of service filed in Court today is taken on record.

2. The petitioner is a pensioner. He alleges inaction on the part of the bank to release his pension.

3. It appears that when the petitioner was in service, his name was Nanda Lal Shaw. After his retirement, he changed his name to Chhote Lal Shaw.

4. The petitioner prays for releasing the pension in the name of Chhote Lal Shaw.

5. The bank and the Provident Fund authority have refused to accede to his prayer for change of name.

6. The Court is of the opinion that, the change of name will change the entire identity of the person concerned. The respondent authorities cannot be directed to release pension in favour of any person without confirming his identity.

7. It will be open for the petitioner to take appropriate steps before the competent forum in accordance with law for remedy, if so advised.

8. No relief can be granted to the petitioner in the instant writ petition. The writ petition fails and is hereby dismissed.

9. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
