For the State The grievance of the petitioner is directed against illegal unlawful encroachment by the private respondents. Mr. De appearing on behalf of the State respondents submits that in view of the allegations made by the petitioner a proceeding has been initiated under Section 10 of the West Bengal State Highways Act, 1964.
Heard the parties. In view of the fact that a proceeding has already been initiated under the aforesaid Act, there is no scope of entertaining this writ petition.
State respondents are directed to conclude the proceedings in accordance with law as expeditiously as possible preferably within a period of three months from date after giving a right of hearing to all the affected parties. I make it clear that I have not gone into the merits of the controversies and the appropriate authorities will not be influenced by any observations made in this order.
With the aforesaid directions, W.P.A. 12613 of 2021 is disposed of.
There shall be no order as to costs.
