The petitioners are the members of Bhado Gram Panchayat and initiated a no confidence motion against the private respondent who is the Pradhan thereof. Upon recording satisfaction under Section 12(3) of the West Bengal Panchayat Act, 1973 the prescribed authority and Block Development Officer, being the 7th respondent herein, convened a meeting on June 02, 2026 and issued notice upon the parties in terms of the Act. The prescribed authority, by a notice issued on May 29, 2026 postponed the meeting due to non availability of police personnel as informed by the Inspector in Charge, Ratua Police Station, Malda. The petitioners seek convention of the meeting by

the prescribed authority and completion of the procedure in terms of Section 12 of the Act.

Upon consideration of the submission made on behalf of the parties, this Court is of the view that since the prescribed authority convened the meeting upon recording satisfaction under Section 12(3) of the Act, which was postponed, the 7th respondent is directed to hold the said meeting within 10 days from the date of communication of this order upon issuance of notice to the parties in terms of the Act and take the proceeding to its logical conclusion within the time limit prescribed in the Act.

The Inspector in Charge, Ratua Police Station, Malda, being the 8th respondent herein, is directed to render necessary assistance to the 7th respondent for holding the said meeting.

The writ petition is disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
