The petitioner was a student of Basirhat College, District : 24-Parganas (North), a college under West Bengal State University. The petitioner has completed his B.Sc. in Chemistry (Hons) from the said college in the year 2014. The petitioner is alleging that his marks in the said examination was increased in Post Publication Review but the University is not issuing fresh mark sheet though he has submitted the earlier one.

Mr. Mitra, learned senior Government Advocate submits that the Provisional Statement of Marks on the Post Publication Review, copy of which has been annexed with the writ petition, is fake as it is not matching with the records of the University. He further submits that the erstwhile Controller of Examination of the University had indulged in different kinds of illegalities possibly he has involved in issuing such fake Provisional Statement of Marks. The said Controller is

facing disciplinary proceeding and criminal proceeding for his misdeeds.

Heard learned Advocates for the parties, perused the materials-on-record.

The petitioner in the year 2014 had appeared in the said examination and waited till 2023.

The University disputes the correctness of the Provisional Statement of Marks. It is the specific case of the University that the marks were not increased on Post Publication Review, therefore, there is no scope to issue fresh mark sheet to the petitioner.

WPA 11863 of 2025 is dismissed without any order as to costs.
