Mr. Imrohi, learned advocate appearing for the petitioner submits that the petitioner has been falsely implicated. All the other coaccused persons have been granted anticipatory bail by the learned Sessions Court. Upon completion of investigation charge sheet has also been submitted and as such, custodial interrogation is not necessary.

Ms. Santra, learned advocate appearing for the State opposes the petitioner's prayer and draws our attention to several documents in the case diary including the statements of the witnesses and the injury report. Prima facie, there are strong incriminating materials against the present petitioner. Overt act has been attributed to him. Considering the nature of such accusations and the injury report, we are not inclined to exercise any discretion in his favour. Accordingly, the application for anticipatory bail being CRM No.5264 of 2021 is dismissed.
