1. Supplementary affidavit filed in Court is taken on record.

2. By filing this contempt application the applicant alleges willful disobedience of the order passed by the learned 5th Judge, Senior division, at Alipore, South 24 Parganas. The applicant herein has filed a miscellaneous case under Order 39 Rule 2A of the Civil Procedure Code, to punish the respondent for willful violation of the impugned order/direction issued by the learned trial Judge.

3. In the light of the pendency of the said application, we are not inclined to entertain this application at this juncture. However, we direct the learned 5th Judge, Senior division, at Alipore, South 24 Parganas to give an early date of hearing of the said miscellaneous application and take a decision on merits and in accordance with law as expeditiously as possible.

4. In the result, the contempt application is dismissed.

5. We are informed that the said Court is lying vacant. In such event, the learned Judge-in-Charge of the said Court shall give priority to the said application and fix an early date for hearing, preferably within a period of three weeks from date.
