The petitioner has alleged that certain individuals are operating a cow-hat on a piece of land belonging to a masjid. The petitioner submits that the land in question is Waqf property, and that the operation of such a cow-hat on Waqf land is illegal.

Mr.

Chakraborty, learned advocate, as representative of certain individual, has sought permission to intervene in this proceedings. He alleged that although the group of individual whom he is representing are necessary parties, they have not been made parties to the present proceedings.

Mr. Yusuf, learned advocate appearing on behalf of the State, submits that the petitioner is merely a member of the Masjid Committee and as such,

has no locus standi to initiate this action. He further proposes that the petitioner may approach the Waqf Board to raise his grievances.

Having considered the submissions of all parties, the writ petition is disposed of with liberty granted to the petitioner to approach the Waqf Board and ventilate his grievances by submitting an application. It is expected that if the Waqf Board receives such an application from the petitioner, it shall consider the same after afforing an opportunity of hearing to the petitioner and other interested parties. If the Board finds merit in the petitioner's contentions, it will take appropriate legal action. Conversely, if the Board finds that the petitioner's contention is without any substance, a reasoned order shall be passed and the same shall be communicated to the petitioner.

The Entire exercise shall be completed within a period of 8(eight) weeks from the date of receipt of the application from the petitioner.

It is clarified that I have not gone into the merit of the petitioner claim raised in this writ petition. All points are kept open to be decided by the Board without being influenced by any observation made in this order.

There shall, however, be no order as to costs. (Partha Sarathi Chatterjee, J.)
