Mr. Anit Kumar Rakshit ]... For the petitioner. A direction to secure expeditious disposal of Judicial Misc. Case No. 4 of 2019 pending before the learned District Judge, Purba Medinipur at Tamluk is the ultimate relief sought for in this case.
Mr. Anit Kumar Rakshit, learned advocate appearing of the petitioner submits that the sole prayer of judicial Misc.
Case is relatable to appointment of legal guardian of a mentally ill son. It is contended further that evidence in connection with referred Misc. Case has already been collected.
In view of the nature of the order proposed to be made in this case, no prior notice is considered to be necessary upon the opposite party.
Service of notice of this application upon opposite party stands dispensed with.
Accordingly, learned District Judge, Purba Medinipur at Tamluk is requested to ensure expeditious disposal of judicial Misc. Case No.4 of 2019, providing sufficient opportunity of hearing to
either of the parties to this case, but without granting unnecessary adjournments, unless it is extremely unavoidable.
While endeavouring such exercise, the learned court below may consider the year of institution of this case, together with the prayer proposed, sought to be obtained, and in context thereof, dispose of the case dispensing with the justice in an expeditious manner.
Petitioner is directed to make communication of this order to the learned court below as well as to the learned advocate appearing in the court below for the opposite party and the opposite party.
With this observation and direction, the revisional application stands disposed of.
Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
