The writ petitioner challenges an order dated 9th March, passed by the Commissioner of School Education, West Bengal. By the impugned order, financial assistance to a recognized school, namely, Shaljhati Tara Sankar Vidyaniketan (Jr. High School) has been declined. This Court after having heard the parties at length on the earlier dated 20th July, 2022 and framed certain questions for the parties to address. The questions have been rendered academic since it appears from the impugned order that there were no students in the school between 2010 and 2017.

This Court is, therefore, of the view that the school even otherwise may not have required any financial assistance. The impugned order is therefore not interfered with.

The writ petition is disposed of. Reserving liberty to the petitioner to renew a prayer for financial assistance in the event there is sufficient student strength in the school.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
