Affidavit of service filed on behalf of the petitioner is taken on record.
Petitioner preferred writ petition previously being WPA 4790 of 2025 which was dismissed by this Court vide order dated 20th March, 2025 and liberty was granted to file afresh on selfsame cause of action. It is submitted that subsequently transfer application was made by the petitioner on medical ground in prescribed proforma and petitioner was medically examined by the concerned Chief Medical Officer of Heath and medical report furnished by the medical expert justifies transfer of the petitioner. It is also submitted that petitioner is suffering from cancer. During course of hearing learned advocate representing the State respondents has submitted a
copy of memo dated 11th April, 2025 issued by the District Inspector of Schools (SE), Malda being respondent no.5 wherefrom it appears that transfer application was also forwarded along necessary documents to the Chairman, West Bengal Central School Service Commission for taking decision. In view of aforesaid situation, the Chairman, West Bengal Central School Service Commission being respondent no.4 is directed to decide transfer application of the petitioner taking into consideration medical report furnished by medical expert within a period of four weeks from the date of communication of this order.
The decision to be taken by the respondent no.4 shall be communicated to the petitioner by ten days thereafter.
The writ petition stands disposed of.
However, it is made clear that suspension of Utsashree portal shall not be a ground for rejecting the transfer application of the petitioner.
Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
