The contention of the petitioners is that despite having been enlisted in the merit list/panel that was prepared for selection of ASHA vide notification dated June 18, 2018, the petitioners have not yet been issued the appointment letters.

Vide notification dated June 18, 2018, the Member Secretary, Raiganj Sub-Division ASHA Selection Committee & Sub-Divisional Officer, Raiganj, Uttar Dinajpur, invited applications from eligible candidates for the post of ASHA for 22 subcentres within 12 gram panchayats under Raiganj Block, Hemtabad Block, Itahar Block and Kaliyaganj Block.

Some of the petitioners had been empanelled, it is alleged. A copy of such alleged panel is annexed as Annexure P/7 at page 97 of the writ petition.

It has been specifically pleaded that the selection process had not been finalised as yet. Under such circumstances, this Court is of the view that the fate of the selection process which was initiated on the basis of notification dated June 18, 2018, should be intimated to the petitioners by the Sub-Divisional Officer, Raiganj Sub-Division ASHA Selection Committee, Raiganj Sub-Division, or any other authority involved in the selection process, within a specific period.

This Court has not gone into the merits of the allegations. The concerned authority shall intimate the petitioners as to whether they were successful, and if so, when necessary steps shall be taken for their engagement.

If the petitioners were found to be unsuccessful, then reasons shall be intimated. The order shall be passed and communicated with all the above information. The entire exercise shall be completed within four weeks from the date of communication of this order.

Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of server copy of this order.
