Learned advocate representing the Panihati Municipality submits that in response to the complaint filed by the petitioner inspection was held on December 17, 2019 and the parties were called for hearing on December 24, 2019.

The petitioner complains of illegal and unauthorized construction.

Again physical inspection was held as per the complaint filed by the petitioner on September 3, 2022. It was found that a building plan bearing No. 387 dated July 22, 2022 was sanctioned for construction of G+2 storied building. On inspection it was found that Sri Ranjit Bardhan constructed his dwelling house as per

the plan sanctioned by the Corporation and there is no deviation found during inspection.

Let the instruction given by the Chairman, Panihati Municipality dated September 6, 2022 be retained with the records.

From the instruction provided by the Municipality it appears that the allegation of the petitioner cannot be substantiated.

In view of the above, no relief can be granted in favour of the petitioner in the instant writ petition. The writ petition fails and is hereby dismissed. The Municipality is directed to forward a copy of the inspection report to the parties at the earliest. Urgent photostat certified copy of this order, if applied for, be given to the parties after completion of all legal formalities.
