Mr. Raja Saha Mr. Biswabrata Basu Mallick ..for the State The grievance of the petitioner is that although the petitioner appeared at a written test as also for the interview for the position of "Data Entry Operator" under the "Rupashree Project" of South 24 Parganas District, the result has not yet been published although almost two years has elapsed from the date of completion of the selection process.
The learned advocate for the petitioner submits that the final panel should be published which would enable the petitioner to know about the fate of the said selection process.
Mr. Saha, learned advocate for the State respondents submits that there is no dispute with the fact that the selection process had been held. However, according to Mr. Saha, the Covid situation was an impediment towards completion of the entire process and final publication of the panel.
There is no doubt that a candidate who has appeared at a selection process is entitled to know whether he has been ultimately selected or not. It is also within the power of the authorities to cancel the selection process in accordance with law, if the situation so arises. However, if the authorities have decided to go ahead with the process then the result should be published. As it is the specific case of the respondents that the entire process has not yet been completed and some time will be required by the authorities to take a final decisions, this Court is of the opinion that the representation of the petitioner must be disposed of by the concerned District Magistrate and the decision must be intimated to the petitioner as to whether the government shall go ahead and publish the result or the government had taken a different view after the interview was over.
This order shall not be construed as a declaration of the right of the petitioner to be appointed or selected.
This order is being passed only on the ground that the fate of the selection process, which was held some time in 2019, should be made known to the candidate.
The representation shall be disposed of by the concerned District Magistrate within a period of six weeks from the date of communication of this order. The decision of the District Magistrate shall be communicated to the petitioner within the aforesaid period.
The writ petition is disposed of.
There will be, however, no order as to costs. Parties are directed to act on the basis of the server copy of this order.
