Having heard the Learned Advocate for the petitioners and on perusal of the materials annexed with the instant revision specially the orders passed by the Learned Special Jude in the Trial Court, this Court find that though initiation and continuation of the proceeding being Special Case No. 145/2021 is under challenge in the instant revision, the grievance of the petitioners is against the order dated 21st April, 2022 passed by the Learned Special Judge directing

issuance of warrant of arrest against the petitioners vide order dated 21st April, 2022.

Having heard the Learned Advocate for the petitioners this Court is of the view that the instant revision can be disposed of here and now with the assistance of the Learned Advocate on behalf of the State. Therefore, Mr. Anwar Hossain, Learned Public Prosecutor-inCharge is requested to assist this Court on behalf of the State. Appointment of Mr. Hossain be regularized by the Learned Legal Remembrancer, Government of West Bengal.

It is submitted by Mr. Chatterjee, Learned Advocate for the petitioners that liberty may be given to the petitioners to surrender before the Learned Special Judge, Howrah in connection with this case within two weeks from the date of this order and in the meantime, warrant of arrest may be stayed.

In view of such clear and unequivocal submission, the instant revision is disposed of directing the petitioners to surrender before the Learned Special Judge, Howrah in connection with Special Case No. 145/2021 within a fortnight. The execution of warrant of arrest be stayed for a period of 14 days from date.

The Learned Special Judge, Howrah is requested to consider the application for bail submitted by the petitioners after their surrender in accordance with law.

The instant revision is, thus, disposed of.

The petitioners are at liberty to communicate this order to the Trial Court obtaining server copy of the order. (Bibek Chaudhuri, J.) Srimanta, A.R.(Ct.)
