1. The petitioner has, in hindsight, after filing of the petition, realised that the tenor of the writ petition is wholly unfounded in view of the Section 36(4) of the West Bengal Co-operative Societies Act, 2006. This particular provision enables the special officer to exercise all powers and perform all duties which under this Act or the Rules or the bye-laws can be exercised or ought to be exercised by the Board or any officer of the Co-operative Society.
2. Thus, so entitled, the special officer has rightly nominated a representative to the said Society, which has also been accepted by the petitioner.
3. In view thereof, the writ petition is dismissed.
4. There shall, however, be no order as to costs.
5. Urgent photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
