Learned counsel for the petitioner submits that the petitioner along with other elected members of the Gram Panchayat, not being less than 2/3 of the total number of elected members submitted a requisition on May 11, 2026 before the Block Development Officer, Kaliachak-III Development Block being the 3rd respondent herein under Section 12 of the West Bengal Panchayat Act, 1973 for removal of the Pradhan and Upapradhan. No step has been taken by the 3rd respondent pursuant to the requisition. The petitioner seeks a direction upon the 3rd respondent to take necessary steps in terms of Section 12 of the Act of 1973.
In view of the above, the 3rd respondent is directed to take necessary steps with regard to the requisition submitted by the petitioner and other members on May 11, 2026 and upon satisfaction that it conforms to the requirement of sub-section (2), specially convene a meeting within seven days from date upon service of notice to the parties and take the proceeding to its logical conclusion in terms of Section 12 of the Act of 1973.
The writ petition is disposed of.
There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
