No. 29 KAUSHIK REJECTED C.R.M.(A) 2068 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Dalkhola Police Station Case No. 38 of 2023 dated 20.02.2023 under Section 20(b)(ii)(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

And In Re : Bhabani Chandra Ray ...... petitioner Ms. Papiya Chattopadhyay ....for the petitioner Mr. Binoy Panda Mr. Subham Bhakat ....for the State Below commercial quantity of narcotic was seized from the co-accused.

The case diary contains call details recording as also money transactions between the co-accused and the petitioner. Involvement of the petitioner in the business of narcotic transpires from the statement recorded under Section 161 of the Code of Criminal Procedure.

Considering the gravity of the offence and the involvement of the petitioner in the incident, we are unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 2068 of 2023 is dismissed.
