grievance is that Government acquired land belonging to the petitioners and has been using the same as a tank. The petitioners filed an application before the Assistant Engineer, Diamond Harbour Sub-Division, Public Health Enginering Department, Government of West Bengal on 28th March, 2019 for adequate compensation in their favour.

Such application has not been considered till date.

Upon hearing the submissions made by the learned counsels for the parties and considering the material on record, I dispose of the writ petition being W.P.A. 12779 of 2021 with a direction upon the respondent No. 5 to consider and dispose of the application

filed by the petitioner on 28th March, 2019 within a period of four weeks from the date of communication of this order after giving opportunity of hearing to all the affected parties including the petitioners, in accordance with law. The order should be communicated to the petitioners within a week thereafter.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
