The petitioner alleges that the Chairman, North Barrackpore Municipality has failed to comply with the order of this court.

On the submissions made by the learned Advocate for the applicant, the following facts have emerged:- a) An order of demolition was passed.

b) The aggrieved party preferred a municipal appeal.

c) The aggrieved party also moved the revisional court praying for certain directions.

d) A Coordinate Bench sitting in civil revision stayed the order of demolition and directed the municipal appeal to be disposed of expeditiously.

e) There was no further scope for the Chairman of the municipality to act and proceed for demolition in view of the order

passed by the revisional court staying the demolition proceedings.

Hence, the court does not find any contempt on the part of the Chairman, North Barrackpore Municipality. The consequences will follow after disposal of the appeal or after disposal of any other proceeding carried from the order passed in the municipal appeal.

The contempt proceedings are dropped.

The contempt application is disposed of.

All the parties are directed to act on the basis of the server copy of this order.
