W.P.A. 11962 of 2025 Meser Ali Mullick.

VS The State of West Bengal & Ors.

Mr. Sandip Ghosh, Mrs. Moumita Ghosh.

...for the Petitioner.

Mr. Swapan Banerjee, Ld. AGP, Ms. Sumita Shaw, Mr. Diptendu Narayan Banerjee, Mr. Soumen Chatterjee.

...for State.

Affidavit-of-service filed by the petitioner be kept 25.06.2025 Court No. 35 Item No. 33.

Rakib with the record.

Petitioner claims that he had entered into an agreement with Indus Towers Limited for installation of tower but certain miscreants have been resisting the work of the masons. Consequently an information was furnished to the Officer-in-Charge of Domjur Police Station, however, till date no action has been taken. State has submitted a report. Report reflects that police authorities have drawn up proceedings under Section 126 of the BNSS, 2023.

Since the police authorities have drawn up proceedings under Section 126 of the BNSS, police authorities would ensure that there is no breach of the peace and/or tranquility and/or any untoward incident resulting because of the installation of the tower taking

place at the behest of the present petitioner, provided the petitioner is lawfully carrying out the work. With the aforesaid observations WPA 11962 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
