1. Affidavits of service filed in Court today are taken on record.

2. The petitioner's prayer for releasing the eighteen years service benefit which she is entitled to receive in accordance with law is alleged to be illegally withheld with mala fide intention by the headmaster of the school.

3. It has been alleged that as the petitioner persistently prayed for disbursing the eighteen years' service benefit, the headmaster along with his accomplices detained the petitioner inside a class room and misbehaved with her outraging her modesty.

4. The petitioner had to be administered treatment in the government hospital. A complaint was lodged before the police by the husband of the petitioner.

5. The petitioner has annexed documents in support of the submission that the headmaster is involved with misappropriation of funds meant for the mid day meal scheme of the school. The Additional

District Magistrate (ZP) requested the District Inspector of Schools, Secondary Education, Malda to take steps against the headmaster.

6. Prayer has been made to direct the authority to take steps for releasing her service benefits.

7. None represents the respondents.

As it appears that there is specific allegation against the headmaster of the school for not disbursing the eighteen years' service benefit in terms of ROPA-2009 accordingly, the Court thinks it appropriate to direct the District Inspector of Schools, Secondary Education, Malda to take necessary steps to ensure that the service benefits of the petitioner in terms of ROPA-2009 on completion of eighteen years' service which the petitioner completed way back on 24th April, 2023 is disbursed in her favour without any further delay.

9. The District Inspector of Schools shall call for all records of the petitioner from the school authority to verify as to whether the petitioner will be eligible to receive the benefit as claimed.

10. If it is found that the relief sought for by the petitioner is payable to her, then steps for disbursing the same shall be taken at the earliest.

11. Learned advocate for the petitioner submits that the petitioner is apprehensive that the headmaster may take retaliatory steps against her upon getting knowledge of the order passed hereinabove.

12. It is made clear that in the event, the petitioner faces any inconvenience at the hand of the headmaster, it will be open for her to immediately bring the same to the notice of the District Inspector of Schools and the police, if required.

13. The writ petition stands disposed of.

14. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Amrita Sinha, J.)
