1. Despite service of notice, the respondents are not represented. Affidavit-of-service filed in Court today be taken on record.

2. The petitioner is the son of the deceased pensioner and claims to be disabled. He placed a certificate dated 11th January, 2024 issued by the Sub-Divisional Hospital, Kharagpur indicating 65% disability. The petitioner's father superannuated as an Assistant Teacher of Ghoshpur Prathamik Vidyalaya under Panskura Circle on 31st October, 1992. He received pension till he died on 25th November, 2023.

3. In those circumstances, the petitioner shall be entitled to pension as a disabled son of Late Harendra Nath Sasmal subject to verification of his disability certificate by the District Inspector of Schools (PE), Purba Medinipur.

4. Let the District Inspector of Schools (PE), Purba Medinipur ascertain the disability of the petitioner independently from C.M.O.H, Purba Medinipur and send an appropriate report to the Director of Pension,

Provident Fund and Group Insurance, West Bengal. If so satisfied, the Director of Pension, Provident Fund and Group Insurance, West Bengal shall issue Pension Payment Order to the petitioner and commence pension to him in accordance with the applicable Rules within a period of two months from the date of receipt of a copy of this order along with a copy of the writ petition. Pension shall be paid to the petitioner prospectively.

5. With the aforesaid directions, the instant writ petition shall stand disposed of.

6. There will be no order as to costs.

7. All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
