Affidavit-of-service filed on behalf of the petitioners is taken on record.

By presenting this writ petition petitioners have prayed for direction upon the concerned police authorities which would facilitate the petitioners to raise construction on the land in question under Pradhan Mantri Awas Yojana.

It is also submitted that private respondents are obstructing the petitioners from raising construction.

Respondent no.7 and State respondents are represented by learned advocates.

Learned advocate representing the respondent no.7 disputes right of the petitioners over the land in question on which petitioners intend to raise construction.

Police authority is not the appropriate authority to decide inter se right of the parties over the land in question.

If petitioners are obstructed by respondent no.7 in raising construction in the event petitioners need to approach the civil court in order to assert their right over the land in question.

Hence, this Court is not inclined to interfere with the writ petition and same stands dismissed.

9.

However, this order shall not preclude the petitioners to approach the civil court in pursuit of remedy.

10. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
