The pre-emptor, the opposite party herein has put the decree of preemption passed under Sections 8and 9 of the West BENGAL Land Reforms Act, 1955 into execution before the 1st Court of learned Civil Judge (Junior Division), Krishnanagar, District: Nadia being Misc. Preemption Case no. 21 of 2018. The petitioners entered appearance in the said Misc. Case and prayed time; the learned Trial Judge by the order impugned being Order No. 96 dated January 15, 2024 has allowed the said prayer but the petitioners are aggrieved since by the said order, the Court below has posted the said Misc. Case for ex parte hearing.

The prayer of the petitioner for filing written objection has been allowed, therefore, fixing a date for ex parte hearing of the Misc. Case is completely inconsequential; the order impugned does not call for any interference.

CO 1686 of 2024 is dismissed without any order as to costs.
