22.03 .24 Sl-50 CRR 1988 of 2011 Ct.33 (S.R.) In the matter of : Sri S.K. Vij The instant criminal revisional application is pending since 2011 and as such, required to be disposed of. None appears for the parties.

The instant revisional application has been filed for quashing of the proceeding being Complaint Case No.25015 of 2010 under Sections 420/406/120B of the Indian Penal Code pending before the learned Metropolitan Magistrate, 8th Court at Calcutta. Perused the contentions of the petition along with the annexed documents.

The learned Metropolitan Magistrate 8th Court at Calcutta did not comply with the provisions of Section 202 of the Criminal Procedure Code, which is mandatory prior to issuance of summons. Under such circumstances, the instant revisional application is disposed of with a direction to the trial court to comply with the provisions of Section 202 of the Criminal Procedure Code. A copy of the order be sent to the Department as well as the trial court for due compliance.
