May 9, 2024 Sl. No. 57 Court No.34 s.biswas CRR 1915 of 2024 In re: An application under Section 483/482 of the Criminal Procedure Code, 1973 Shweta Loharuka Vs.

Sri Aditya Vikram Agarwal & ors.

Mr. Moyukh Mukherjee Mr. Koustav Lal Mukherjee Mr. Sarthak Mondal Ms. Sarmistha Basak ... for the petitioner The revisional application was admitted in the year 2022 and till date the same is pending.

Learned advocate for the petitioner submits that the petitioner is seriously prejudiced as further investigation has been interfered with and the interim order on the issue relating to further investigation which was granted by the learned Magistrate has been stayed.

Having considered the issues involved, the fact that the revisional application is pending for more than two years, I direct that on the next date so fixed (as has been informed i.e. on 24th July, 2024), the learned judge being learned Additional Sessions Judge, Fast Track 4th Court, Barasat, would dispose of the same on the date so fixed and/or within a month thereafter, by no means the time limit should be stretched beyond 31st August, 2024. Within the aforesaid time schedule, the learned revisional court would be at liberty to fix as many number of dates, it thinks fit and proper, but should stick to the time line i.e. 31st August, 2024.

It is further directed that the hearing of the revisional application would continue in spite of the resolution of the local bar and the participating advocates will not stall the hearing of the revisional application in spite of any resolution. With the aforesaid observation, the revisional application being CRR 1915 of 2024 is disposed of.

All parties are to act on the basis of the server copy of the order.
