A direction to secure expeditious disposal of an application filed under Section 7(2) of West Bengal Premises Tenancy Act, is the ultimate relief sought for in this case.

Adverting to order dated 28th September, 2021 passed in C.O. 1714 of 2021, learned advocate appearing for the petitioners submits that despite direction passed by the court below, the pending interlocutory application has not yet been disposed of.

No other point is raised requiring address by this Court.

In view of the nature of the order proposed to be made in this case, no prior notice is considered to be necessary upon the opposite party.

Service of notice of this application upon opposite party stands dispensed with.

Accordingly, the learned Civil Judge (Junior Division), 4th Court, Howrah, in Title Suit No. 1422 of 2019 is requested to take up the pending application,

referred above, either on the date scheduled by the court below, or if for any reasons whatsoever, the application could not be taken up, the same may be taken up within three weeks thareafter peremptorily, providing sufficient opportunity of hearing to either of the parties to this case, and bearing in mind the message already contained in C.O. 1714 of 2021, but without granting unnecessary adjournments, unless it is extremely unavoidable.

Petitioners are directed to make communication of this order to the learned court below as well as to the learned advocate appearing in the court below for the opposite party and the opposite party.

With this observation and direction, the revisional application stands disposed of.

Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
