This writ application has been filed on account of no action taken by the Chairman, Panihati Municipality, being the respondent no.2 herein, on a representation dated 20th March, 2023 informing illegal construction made by the private respondent nos.6 and 7 and the said representation was received by the respondent no.2 on 21st March, 2023.

Learned advocate appearing on behalf of the respondent nos.2 to 4 has submitted that the subject land was inspected and no irregularity was found. 5.

After careful perusal of the writ application and the documents annexed herein, I find that the respondent no.2 after receiving the representation did not dispose of the same by any reasoned order.

In the premise set forth above, the respondent no.2 is directed to dispose of the representation dated 20th March, 2023 by passing a reasoned order within six weeks from date after giving an opportunity of hearing to both the parties to the said representation and to intimate the said order to the petitioner within one week thereafter.

With the aforesaid observation and direction, the writ application stands disposed of.

All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
