Mr. Sourav Sen, Sr. Advocate Mr. Pran Gopal Das ... for the petitioner By the order impugned the learned Judge, 9th Bench, City Civil Court at Calcutta passed an order of stay of all further proceedings of the execution case subject to payment of occupation charges.
After some argument, Mr. Sen, learned senior advocate on instructions from his learned advocate on record submits that a direction may be passed upon the learned judge of the 1st appellate court to dispose of the title appeal expeditiously.
In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite parties. However, the learned advocate appearing for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or upon the learned advocates representing them before the learned judge of the 1st appellate court. From the order-sheets appended to this application this Court finds that 16th June, 2025 has been fixed for hearing of the Title Appeal No. 65 of 2024.
Considering the fact that the appeal arises out of a decree for eviction on the ground of default and reasonable requirement this Court is of the considered view that such an appeal is required to be disposed of expeditiously.
In view thereof, C.O. 1910 of 2025 stands disposed of by requesting the learned Judge, 9th Bench, City Civil Court at Calcutta to take up the hearing of the Title Appeal No. 65 of 2024 on the next date fixed i.e. on 16th June, 2025, if the same is otherwise ready for hearing and to make an endeavour to dispose of the same as expeditiously as possible on or before 15th September, 2025 without granting any unnecessary adjournments to either of the parties.
No order as to costs.
Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
