Learned advocate appearing for the petitioner submits that the subject matter of recovery in the present case relates to 32 kgs of ganja from 8 persons. The said recovery was never from the present petitioner or others but from the bunker of a bus. Petitioner is in custody for more than seven months and although, chargesheet has been submitted but there has been no progress in the case.

Learned advocate appearing for the State opposes the prayer for bail.

I have taken into account the quantum of seizure and I am of the view that rigors of Section 37 of the NDPS Act is attracted. Petitioner would renew his prayer for bail after the evidence of the seizure list witnesses are over.

At this stage, the prayer for bail of the petitioner in CRM (NDPS) 1211 of 2026 is dismissed.
