Records of the writ petition reflect that the petitioner has already approached the learned ACJM, Alipore by way of invoking the provisions of section 156(3) of the Code of Criminal Procedure, 1973. Since the petitioner has invoked an alternative remedy available under the statute, the petitioner has to follow the remedies available under the statute i.e. the Code of Criminal Procedure. Accordingly, I am of the view that the present writ petition is not maintainable. However, petitioner is granted liberty to take steps in accordance with law.

With the aforesaid observations WPA 13145 of 2024 is disposed of.
