Learned advocate appearing for the petitioner submits that petitioner is similarly situated as Dilip Khan who has been granted bail in CRM (NDPS) 998 of 2026.
Learned advocate appearing for the State opposes the prayer for bail but do not refute that the petitioner and the other accused Dilip Khan is not similarly placed.
Having regard to the totality of the circumstances and the subject matter involving recovery of 94 bottles of phensedyl, I am inclined to extend the same benefit to the petitioner as that of the other accused namely, Dilip Khan.
Accordingly, petitioner namely, Sariful Sk be released on bail on same terms and condition as was imposed to other accused
persons namely, Dilip Khan and Bablu Pramanik @ Napit in CRM (NDPS) 998 of 2026 and CRM (NDPS) 519 of 2026. Thus, the prayer for bail of the petitioner in CRM (NDPS) 1213 of 2026 is allowed.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
