Since Mr. Pantu Deb Roy, learned advocate who usually appears for the State respondents, his appearance may be regularized along with Mr. Avirup Mondal, learned advocate and Mr. Arun Kumar Saha, learned advocate who are already engaged in this matter.

The petitioner is a permanent permit holder bearing no.PSTP/2004/2020 which is valid till 21.12.2025. The petitioner states that the respondent authorities being RTI, Bankura vide notice Memo No. 450 (8) dated 27.02.25 issued a notice for change of route as proposed by the private respondent. Thereafter the petitioner

raised an objection to such issuance of the notice of changing the time-table of private respondent at the point of Goaltore which was included in the proposed time-table by the RTA, Bankura without obtaining any no-objection certificate from RTA, Paschim Medinipur. Since the petitioner is the existing operator under RTA, Paschim Medinipur, he cannot raise his objection before the RTA, Bankura.

The petitioner has made a representation dated 02.05.25 which remains pending for consideration. He also prays that the private respondent is running the bus service with an illegal permit and therefore wishes to raise an objection debarring the private respondent to ply on the said route.

The State respondent objects to the contention of the petitioner and relies on paragraphs 4 and 5 of the report filed on 25th June, 2025 After hearing the rival contentions of the parties and perusing the materials available in the record I am of the considered view that since the issue pertains with regard to the N.O.C. to be

obtained from the two respective Regional Transport Authorities, namely, Paschim Medinipur and Bankura, the petitioner is directed to make a fresh application before the State Transport Authority, West Bengal within a week from date and the same shall also be served upon the Regional Transport Authority, Paschim Medinipur and Bankura i.e. respondent nos. 2 and 5 respectively. The State Transport Authority shall fix a date of hearing and serve a notice upon all the concerned parties including the respective Regional Transport Authority of Paschim Medinipur and Bankura and private respondent. The State Transport Authority with the assistance of the Regional Transport Authority of Paschim Medinipur and Bankura shall consider the case of the petitioner and pass a reasoned order in accordance with law upon affording an opportunity of hearing and shall communicate the same to the petitioner within a week thereafter. The entire exercise is to be completed within 60 days by the State Transport Authority

from the date of receipt of the application filed by the petitioner.

The writ petition is disposed of without going into the merits of the case.

It is needless to mention that the State Transport Authority being the highest authority in the transport department shall introduce seamless procedures for the operation of a particular district to deal with against the Regional Transport Authority of another district in respect of objections raised for approval of time table in intra state routes.
