05.06.2023 sdas rejected C.R.M.(NDPS) No. 1058 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Hili Police Station Case No. 216 of 2022 dated 18.09.2022 under Sections 20(b)(2)/21(c )/22(c )/23(c )/27A of the NDPS Act.

And In Re : Ajit Sarkar .... petitioner Mr. Kaushik Chaudhury Ms. Busra Khatun ....for the petitioner Mr. Sanjoy Bardhan Mr. Palash Chandra Majhi ...... for the State Heard the learned Counsels for the parties.

We have considered the materials on record. Two large volumes of contraband articles containing Buprenorphine Injections and 5 kgs. of Ganja were recovered from the house of the petitioner. Nothing is placed on record to show that the said articles were stored for medical purposes.

Under such circumstances and in view of statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected.
