Petitioner is aggrieved by the fact that the representation was advanced to the Inspector-in-Charge Taldangra Police Station on or about 05.05.2025 but the same till date has not been responded. Learned advocate submits that at the instance of the private respondent no.8 certain miscreants are carrying out anti-social activities including consumption of liquor and to that effect petitioner intended to install a gate for preventing such anti-social activities. The respondent no.8 objected to the same. Petitioner expresses his agony as his safety, enjoyment of peace to life and property are being disrupted by the same miscreants and anti-socials and the same is at the behest of the respondent no.8. State has submitted a report. Report reflects that the police authorities have drawn up a proceedings under Section 126 of the BNSS.
Having regard to the issue relating to installation of gate, police authorities obviously are not in a position to decide the same. However, the police authorities would ensure that no anti-social activities as complained of by the petitioner be carried out thereby interfering with the peaceful enjoyment of the property. To that effect, if any cognizable offence is made out, police authorities would not hesitate to register any case and if required a police picket be deputed at the costs of the petitioner. Police authorities would also continue their surveillance and ensure that no breach of the peace and/or tranquility takes place or/any untoward incident results. With the aforesaid observations WPA 11936 of 2025 is disposed of.
Report so submitted by the State be kept with the record.
Copy of the report be handed over to the learned advocate appearing for the petitioner.
